The following privacy policy (the “Privacy Policy”) governs the online information collection practices of My Texas Parks, LLC (“we” or “us”).

Specifically, it outlines the types of information that we gather about you while you are using our website and/or our mobile applications (collectively, the “Site”) and any time you purchase tickets whether directly through the Site or at our kiosks or ticket sales office at Longhorn Cavern State Park or through group bookings via telephone; and in each case, the ways in which we use this information.  When you provide information to buy tickets to our sales office or through group bookings via telephone, our staff at the sales office or working with you on group bookings inputs this information into the Site on your behalf (and therefore this privacy policy will apply to the information that you provide to us at the sales office or through the phone call for group bookings).

This Privacy Policy does not apply to any information you may provide to us or that we may collect other than through the Site or in connection with purchasing tickets at our sales office or through a group booking telephone call.

Please read this Privacy Policy carefully. By visiting and using the Site or purchasing tickets, you agree that your use of our Site and purchasing of tickets, and any dispute over privacy, is governed by this Privacy Policy.

From time to time we may change this Privacy Policy, in which case we will post the revised Privacy Policy on the Site and update the Effective Date of the policy to reflect the date of the changes. By continuing to use the Site after we post any such changes, you accept the Privacy Policy as modified.

What Information is Collected?

The information that we collect about you as described herein into two general categories:

We may collect and store personally identifiable information and other information that you voluntarily supply while on the Site or purchasing tickets either at our sales office or through a phone call for group bookings. Personally identifiable information is information that can be used to contact you or that gives your specific identity.  This information is generally demographic information (such as your name, address, email address, phone, and other contact information and/or credit card information) that you electronically submit when you use or access to the Site (including purchasing tickets through the sales office or through a group booking phone call) or information contained in search requests or questions that you submit to us via the Site. If you decline to supply or provide us with certain information that we request while using the Site, you may not be able to use or participate in some or all of the features offered through the Site.

  1. Information that is Automatically Collected.

We also collect and store information that is generated automatically as you navigate through the Site.

In order to collect this information, we may place, view, and/or use “cookies”, web server logs, web beacons, pixels or other electronic technologies to collect statistical and other information about you and your use of the Site. With Whom do we share Information?

We disclose your personal information with our affiliates and designated service providers, for the purposes set out in this Privacy Policy. We may also disclose to third parties, including advertising networks, data analytics providers and social networks, your use of the Site, including online identifier, Internet Protocol address, and Internet or other electronic network activity information, and the services provided by us for the purposes set out in this Privacy Policy. We may disclose your personal information with a sponsor or other third party (“Third-Party Provider”) that provides you with offers or promotions that may be of interest to you. The collection, further use, and/or disclosure of your information by Third-Party Providers or by other third parties is not done pursuant to this Privacy Policy. Rather, such collection, use, and/or disclosure is governed by the third parties’ privacy policies.

PLEASE NOTE that when you purchase tickets or other services from us the information you provide (including all demographic information) is automatically sent to our Third Party Provider, The Flybook.  All information you provide is gathered and retained by the Flybook pursuant to its privacy policy.  The Flybook’s privacy policy as of the date above is located at https://www.theflybook.com/legal-stuff.  If you have any questions regarding the privacy policy of The Flybook, you should contact them directly for more information.

Security of the information

We follow generally accepted industry standards to protect the personally identifiable information as well as the financial data submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security. If we learn of a breach of our security system or processes, we may attempt to notify you electronically so that you can take appropriate protective steps.  Note that the information you provide including your financial information is transmitted to The Flybook and The Flybook hosts and maintains such information.

By using the Site, or providing personally identifiable information to us, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Site, including through our ticket office. In the event of a breach, we may post a notice on our Site and/or send you an email at the email address you provided. YOU MAY HAVE ADDITIONAL RIGHTS TO RECEIVE WRITTEN NOTICE OF SECURITY BREACHES UNDER APPLICABLE LAW OF YOUR JURISDICTION.

Children’s Privacy Statement

This Site is not directed to children under the age of thirteen (13) and we do not knowingly collect personally identifiable information from children under the age of thirteen as part of the Site’s services and products. Because we do not collect any personally identifiable information from children under the age of thirteen (13) as part of the Site, we do not condition the participation of a child under thirteen in the Site’s online activities on providing personally identifiable information.

Governing Law

This policy and the use of this Site are governed by Texas law. Any claim related to the Site or this policy shall be brought in a Federal or state court in Austin, Texas, within one year after the claim arises. You agree no such claim may be brought as a class action. Users of the Site (including those that purchase tickets through the sales office or via telephone for group bookings) consent to the jurisdiction and venue of such courts as the most convenient and appropriate for the resolution of disputes concerning this policy. The Site is controlled, operated and administered entirely within the United States. If you are located outside the United States, please note the information you provide to us will be transferred to the United States. You hereby consent to this transfer.

In the event case of any conflict between the terms of this policy and the terms of any electronic or machine readable privacy policy (for example, a P3P electronic privacy policy), the terms of this written policy shall control.

Privacy Notice for California Residents

This notice is part of the overall Privacy Policy above, but it applies only to California residents. It explains some additional rights and details that were introduced by the California Consumer Privacy Act of 2018 (the “CCPA”).

Subject to certain restrictions, California residents have the right to request that we disclose what personal information we collect about you, to delete any personal information that we collected from or maintain about you, and to opt-out of any sale of personal information about you. As a California resident, you also have the right to designate an agent to exercise these rights on your behalf. If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by us to our affiliates and/or third parties for their direct marketing purposes.
